7405 SAYILI KANUN’LA SPOR KULÜPLERİNE İLİŞKİN YAPILAN DÜZENLEMELER

Abstract
Bu çalışmada, 7405 sayılı kanun’la spor kulüplerine ilişkin yapılan düzenlemelerin incelenmesi amaçlanırken, tarama modeli kullanılarak spor kulüpleri ile ilgili kanun ve yönetmelikler incelenmiştir. 7405 sayılı kanununda, spor kulüplerinin dernek statüsünden çıkarılarak Gençlik Spor Bakanlığına bağlı bir yapı haline getirilmesi planlanmaktadır. Spor kulüplerine ait yapılan yasal düzenlemelerin temelinde; spor kulüplerinin hukuki yapısı, mali işleyiş ve denetimi, yönetim ve idari düzenlemeler, disiplin ve ceza ile ilgili yapısal çerçeve yer almaktadır. Yapılacak iyileştirmeler ve düzenlemeler, spor kulüplerinin daha etkin yönetim ve denetim sürecine katkı sağlamaktadır. Bu nedenle, Türk spor sisteminde kurumsallığın artırılması, mali sürdürülebilirliğin sağlanması ve uluslararası standartların güçlendirilmesi hedeflenirken, yönetim sürecinde şeffaflık ve sürdürülebilirlik sağlanması amaçlanmaktadır.

Abstract
The objective of this study is to analyse the regulations made regarding sports clubs with Law No. 7405. The related laws and regulations are analysed using a descriptive model. The legal provision under scrutiny, namely Law No. 7405, seeks to modify the legal status of sports clubs, transitioning them from the status of associations to that of structures affiliated with the Ministry of Youth and Sports. The legal framework governing sports clubs is predominantly characterised by regulations pertaining to the legal structure of sports clubs, financial operations and oversight, management and administrative regulations, as well as the structural framework related to discipline and penalties. The planned improvements and regulations aim to contribute to a more effective management and oversight process for sports clubs. The overarching objectives of this legislative initiative encompass the augmentation of institutionalisation within the Turkish sports system, the assurance of financial sustainability, and the enhancement of international standards. Additionally, the legislation seeks to foster transparency and sustainability in the management process.
