Abstract

Türkiye’nin yönetim yapısında köklü değişiklikler getiren Cumhurbaşkanlığı Hükümet Sistemi (CHS); demokratik, siyasi ve yönetsel kazanımları konsolide edecek bir anlayışla dizayn edilmiştir. 16 Nisan 2017 tarihinde yapılan referandumla halk tarafından onaylanan yeni sistem, 24 Haziran 2018 genel seçimiyle birlikte bütünüyle uygulanmaya başlanmıştır. Daha güçlü ve merkezi bir yönetim yapısıyla siyasi istikrar ve etkinlik sağlamayı hedefleyen CHS; idari ve bürokratik yapıda yalınlık, yeniliklere açık ve hızlı adapte olma, yetki ve sorumluluk dengesinde netlik, teknolojik ve dijital dönüşümleri önceleyen, beşeri kaynaklardan etkin yararlanan, karar alma-verme süreçleri hızlı, küresel rekabeti ve ortak aklı kurumsallaştıran özellikleriyle ön plana çıkmaktadır. Mayıs 2023’te yapılan genel seçimlerle birlikte CHS’nin ilk dönemi de deneyimlenmiş ve bu esnada ortaya çıkan aksaklıkların giderilmesi için birçok koruyucu ve dönüştürücü reformlar yapılmıştır. Böylelikle 16 Nisan referandumu öncesinde sisteme yöneltilen eleştiriler içerik olarak değişmiş ancak demokratik normlara uygunluk, güçler ayrılığı ve şeffaflık gibi konularda yapılan eleştiriler ise yoğunlaşarak devam etmiştir. Dolayısıyla hem sisteme yönelik eleştirilerin giderilmesi hem de sistemin kurumsallaşması adına sadece hükümet sistemin restore edilmesinden ziyade hukuk, insan hakları, özgürlükler ve adalet konuları başta olmak üzere her alanda tamamlayıcı reformlara ihtiyaç duyulmaktadır. Bu çalışmada ilk dönemini tamamlayan CHS’nin kurumsallaşması adına kat ettiği mesafe ele alınmış olup; sistemin sürdürülebilirliği ve etkinliği açısından liyakat, hesap verebilirlik, yasama erkinin etkinliği, kurumsal ve yargı bağımsızlığı gibi alanlarda iyileştirmeler yapılması önerilmiştir.

Abstract

The Presidential Government System (PGS), which has introduced profound changes to Türkiye’s administrative structure, was designed with an approach aimed at consolidating democratic, political, and administrative gains. The new system, approved by the public through a referendum held on April 16, 2017, was fully implemented following the general elections on June 24, 2018. Aiming to ensure political stability and effectiveness through a stronger and more centralized governance model, the PGS stands out with its streamlined administrative and bureaucratic structure, openness to innovation and rapid adaptation, clarity in the balance of authority and responsibility, prioritization of technological and digital transformation, effective utilization of human resources, swift decision-making processes, and its institutionalization of global competitiveness and collective wisdom. With the general elections held in May 2023, the first term of the PGS was completed, during which numerous protective and transformative reforms were enacted to address the shortcomings that emerged. As a result, while the content of criticisms directed at the system prior to the April 16 referendum has evolved, concerns regarding compliance with democratic norms, separation of powers, and transparency have intensified and persisted. Therefore, in order to both address criticisms of the system and further institutionalize it, there is a need for comprehensive reforms—not only to restore the government system but also to enhance the rule of law, human rights, freedoms, and justice across all areas. This study examines the progress made in institutionalizing the PGS following its inaugural term, and recommends improvements in areas such as meritocracy, accountability, the effectiveness of the legislative branch, and institutional and judicial independence to ensure the system’s sustainability and efficiency.
