Abstract

Türkiye, 1876’dan beri hukukî açıdan anayasalarla yönetilen demokratik bir ülkedir. Türkiye’nin ilk anayasası 1876 tarihli Kanun-ı Esasî’dir. Bu anayasa, her ne kadar istibdat döneminde uygulanmamış olsa da; 1924’e kadar 1921 Teşkilât-ı Esâsiye ile birlikte yürürlükte kalmıştır. Türkiye’nin üçüncü ve uzun ömürlü toplum sözleşmelerinden birisi olan 1924 Anayasası, ülkede demokrasi ve hükümet sistemi bağlamında güçlü bir merkezi yapının oluşumunda önemli bir rol oynamıştır. Bu bağlamda, tarafımızdan hazırlanan bu makalede 1924 Anayasası’nda nasıl bir hükümet sistemi öngörüldüğü ve bu hükümet sisteminin nasıl uygulandığı konusu ayrıntılı bir biçimde ele alınmıştır. “Tarihî ve Hukukî Açıdan 1924 Anayasası’ndaki Hükümet Sistemi Üzerine Bir Değerlendirme” adlı çalışmanın hazırlanmasındaki temel amaç, 1924 Anayasası’nda meclis hükümeti sistemiyle parlamenter sistem arasında yer alan ve her iki hükümet sisteminin de özelliklerini taşıdığı değerlendirilen karma hükümet sisteminin nasıl olduğunu ve bu hükümet sisteminde yasama, yürütme ve yargı erklerinin konumlarının nelerden ibaret olduğunu teferruatlı bir şekilde ortaya çıkarmaktır. Bunun yapılmasındaki temel hedef ise 1924’ten 27 Mayıs 1960 Askeri Darbesine kadar geçen tarihsel süreç içerisinde karma hükümet sisteminin, Türkiye’nin anayasal ve demokratik gelişimine ne gibi katkılar verdiğini belgelerle incelemektir. Bu çalışma, telif eserlerden istifade edilerek oluşturulmuştur. Ayrıca tarafımızdan hazırlanan bu makale, nitel bir çalışma olup; eserde doküman analiz tekniği kullanılmıştır.

Abstract

Turkey is a democratic country that has been governed legally by constitutions since 1876. The first constitution of Turkey is Kanun-i Esasi, dated 1876. This constitution remained in force until 1924 together with the 1921 Teşkilat-ı Esâsiye. This constitution remained in force until 1924 together with the 1921 Teşkilat-ı Esâsiye. The 1924 Constitution, which is one of Turkey's third and long-lasting social contracts, played an important role in the formation of a strong central structure in the country in the context of democracy and government system. In this context, in this article prepared by us, the issue of what kind of government system was envisaged in the 1924 Constitution and how this government system was implemented were discussed in detail. The main purpose in the preparation of this study is to reveal how the mixed government system, which is located between the parliamentary government system and the parliamentary system in the 1924 Constitution, and which is considered to have the characteristics of both government systems. In addition, it is aimed to reveal in detail what the positions of the legislative, executive and judicial powers in this government system consist of. The main goal in doing this is to examine with documents what kind of contributions the mixed government system made to the constitutional and democratic development of Turkey in the historical process from 1924 to the May 27, 1960 Military Coup. This study was created by making use of copyrighted works. In addition, this article prepared by us is a qualitative study; The document analysis technique was used in the work.
